จากการสอบสวนเบื้องต้น นายณัฐพงษ์ ให้การรับสารภาพว่าได้รับการติดต่อจากนายโอ๋ ไม่ทราบชื่อนามสกุลจริง ให้มารับกัญชาที่ จ.บึงกาฬ โดยจะได้รับค่าจ้างคนละ 10,000 บาท รวมเป็น 30,000 บาท โดยให้ขนไปส่งบริเวณพื้นที่ จ.นนทบุรี จึงได้ชักชวนเพื่อนมาด้วยกันรวมเป็น 3 คน โดยใช้รถยนต์ของนายนัคราช เป็นพาหนะในการลำเลียงออกจาก กทม.เมื่อวันที่ 18 ก.ค.เวลาประมาณ 08.00 น.มาถึงบึงกาฬ ประมาณ 1 ทุ่มและนอนรอโทรศัพท์ให้นำรถไปขนกัญชา จึงถูกจับกุมได้เสียก่อน
จากการจับกุมผู้ต้องหาทั้ง 3 คนพร้อมกัญชาแห้ง 203 แท่งที่บรรทุกมาในรถกระบะตู้ทึบดังกล่าว ทำให้เกิดปัญหาในทางปฏิบัติ สำหรับพนักงานสอบสวนที่รับเป็นคดีเอาไว้ ว่าจะดำเนินการได้อย่างไรบ้าง เนื่องจากเป็นคดีแรกที่เกิดขึ้นหลังจากปลดล็อคกัญชาแล้ว ผู้ต้องขังที่อยู่ในเรือนจำก็ถูกสั่งปล่อยตัวออกจากคุกทั้งหมด ยกเว้นที่มีคดียาเสพติดประเภท 1 ด้วย เช่นถูกจับทั้งกัญชาและยาไอซ์ แม้จะถูกปล่อยตัวคดีกัญชา แต่ต้องถูกขังในคดียาเสพติดประเภท 1 ต่อไป จนกว่าจะครบกำหนด
นายนายอธิภัทร อยู่คุ้มญาติ หน.ฝ่ายปราบปรามฯ ด่านศุลกากรบึงกาฬ ได้ให้สัมภาษณ์ทางโทรศัพท์เพิ่มเติมว่า ตามข้อหา“ร่วมกันนำของต้องห้ามต้องกำกัดเข้ามาในราชอาณาจักรโดยไม่ผ่านพิธีการทางศุลกากร” ซึ่งเป็นข้อกล่าวหาเดียวที่ด่านศุลกากรบึงกาฬแจ้งไว้ ในข้อหานี้มีอัตราโทษ ปรับไม่เกิน 4 เท่าของมูลค่าสินค้าที่นำเข้ามาโดยไม่ผ่านพิธีทางศุลกากร จำคุกไม่เกิน 10 ปี หรือทั้งจำทั้งปรับ ตาม พ.ร.บ.ศุลกากร มาตรา 242 ปี พ.ศ.2560 ได้แจ้งประเมินราคากัญชาที่จับได้ให้พนักงานสอบสวน สภ.เมืองบึงกาฬไปแล้ว คือประมาณ กก.ละ 3,500-5,000 บาท ต้องรวมภาษีอากร กก.ละ 4.20 บาทและภาษี 7% เข้าไปด้วย จึงเป็นราคาปรับสุทธิ ของกลางมีกัญชาและรถยนต์ต้องริบ ส่วน พ.ต.ท.อ่อนสี สีดามาตย์ พนักงานสอบสวน สภ.เมืองบึงกาฬ เจ้าของคดี ได้ให้ประกันตัว 3 ผู้ต้องหาไปแล้วใช้หลักทรัพย์คนละ 150,000 บาท จะต้องทำสำนวนและรวบรวมพยานหลักฐานส่งพนักงานอัยการพิจารณาต่อไป.
